RESTORATIVE JUSTICE AS A GATEWAY TO JUSTICE FOR STREETS POPULATIONS
Abstract
The main objective of this article is to analyze how Restorative Justice can be a gateway to justice for the homeless population. With this, initially, some considerations about the emergence of the restorative paradigm will be explained as an alternative to the model of retributive justice, taking into account the principles, values and purposes of Restorative Justice. In addition, essential points about the constitutional principle of access to justice will be listed, revealing its procedural and extrajudicial facet, as well as what is meant by a feeling of justice, so that it is appropriate to deal with the use of Restorative Justice as a measure to ensure access to justice for homeless people, as provided for in Resolution No. 425/21 of the National Council of Justice. For this, the deductive method was used, so that the research has a qualitative nature, being supported by a documentary and electronic bibliographic survey. In the final considerations, a recapitulation of all the topics arranged throughout the work is made, with critical assertions in the sense that greater commitment is needed in the creation and implementation of judicial policies aimed at promoting restorative practices by the homeless population.
