Constitutionalization of women's rights in Brazil: a challenge to the incorporation of the gender perspective in the law

The article analyzes the process of constitutionalization of women's rights in Brazil and presents a challenge to the incorporation of a gender perspective in the legal field. Based on a feminist epistemology and the theory of the Constitution as a cultural science, the work highlights the political struggle of more than half of the population towards the legal recognition of their demands, emphasizing the role of women in the last National Constituent Assembly. It is also exposed the androcentric and sexist nature of the daily legal practice, proposing the adoption of another legal paradigm, specially dedicated to the social and political emancipation of Brazilian women.
