Abstract

This article analyzes copyright in its multiple meanings, going beyond the strictly normative view enshrined in Article 5 of the Federal Constitution and Law No. 9,610/1998. It seeks to demonstrate that copyright is a manifestation of human individuality, endowed with a sui generis character and social function, whose understanding requires reflection beyond the sphere of property rights. Based on a review of the literature and documentation, using the deductive method, the tensions between patrimonial rights and moral rights of authors are examined, emphasizing the relationship of the latter with human dignity. Thus, a contemporary approach to copyright is defended, one that reconciles the protection of intellectual creation with access to culture and information, reaffirming it as an instrument for the realization of fundamental rights in the Brazilian and international legal landscape.
