ANALYSIS OF ANONYMITY OF SEMEN DONORS

Introduction: The present work is inserted in the context of the anonymity of the donor of genetic material in domestic artificial insemination. Objective: To present and analyze the problems arising from the non-compliance with the anonymity of the donor of genetic material in domestic artificial insemination. Method: This is an exploratory research with a qualitative approach, based on the analysis of the jurisprudence of the courts of Justice of the southern and southeastern states of Brazil related to domestic artificial insemination IAC. Results: The anonymity of sperm donors is not maintained in most of the cases studied. Donors are often found through groups on social networks or are people close to the couple who will perform the procedure. Considerations: Failure to comply with anonymity by the people involved in the procedure may generate, over time, possible ethical-legal consequences. This includes the possibility for the donor to request recognition of paternity, as well as the possibility for the child, represented by its mother, to request alimony and other rights arising from filiation.
