LAW IN LITERATURE: reflections on the novel Torto arado and social rights in a hidden rural Brazil
ABSTRACT
This article aims to reflect on the novel Crooked Plough and Social Rights in a Hidden Rural Brazil, identifying the exclusionary role of the State in the realization of these rights. For this, the methodological assumptions of the current of Law in Literature presented by Karam (2017) are used, through the deductive method, with a bibliographic and documentary approach through the review of doctrine and legislation relevant to the subject. The work presents the characters as rural Workers descendants of slaves who fight for survival, land and rights. The historical stain of slavery present in the text presents the structural racism and the relations of servitude in work to which freed blacks were subjected after abolition, in exchange for housing. Literature offers new ways of understanding human nature and the challenges that law faces in the contemporary world. The representations of justice and law perceived in the novel, and the perpetuation of slave labor, show that in the historical context and in the current reality, the State plays an exclusive role in the realization of Social Rights in the most remote rural areas of the country.
