PLURIVULNERABILITY IN THE PROTECTION OF DEAF WOMEN BEFORE THE MARIA DA PENHA LAW AND THE APPLICATION OF THE INTERNATIONAL CLASSIFICATION OF FUNCTIONALITY, DISABILITY

Abstract

The vulnerability of women in situations of violence is identified and the situation worsens when it affects disabled women. In this sense, the issue of the plurivulnerabilities of these (disabled) women in situations that must be recognized by the Judiciary is discussed, bringing the proposal of the International Classification of Functioning, Disability and Health, from the WHO, as conditions in the composition of the Risk Form as parameters of Judiciary action and application of public policies to protect disabled women who are victims of domestic violence. There is also an approach to this theme on women with sensory disabilities (deaf) who are victims of gender-based violence and their communication impairment. The research uses specialized doctrine, analyzes documents to reach an understanding of the necessary use of the ICF, and, therefore, a dialectical methodology is applied.
