Abstract

This work seeks to analyze the relationship between constitutionalism and the constitutionalization of public policies, as well as their effects and implications in contemporary society. Constitutionalism and societies have undergone several changes throughout history. The constitutions evolved beyond the organization of the State, covering the most diverse themes in the constitutional texts. The constitutionalization of public policies appears in this context, elevating certain policies to constitutional status. In the present work, we seek to contribute to the analysis between the two movements, and the possible effects of this constitutionalization and the legal and economic impacts.
