Abstract

This study aims to analyze vertically and with problematizations, relating the following themes: “right to freedom of expression online and offline” and “hate speech”. Through the hypothetical-deductive method, with research in relevant scientific articles, doctrine and jurisprudence, this work will seek to answer the following questions: does freedom of expression online or offline have limitations? What is hate speech? Is hate speech supported by freedom of expression? Thus, although freedom of expression is the basis for other fundamental rights, with regard to the online environment, it appears that the central legal concepts are outdated, requiring the adoption of appropriate institutions, regimes and political norms for the resolution.
