Abstract

In this article, we sought to revisit the main paradigms that make up the evolutionary path of penal schools to investigate the correlation and power of influence of penal ideologies in the development of methods and techniques of legal research on the criminal phenomenon. Along these lines, the main objective of this work was to understand the relationship between the dominant penal ideology and its influence on the development of epistemology and methodology applied to research in criminal law. Firm in this purpose, it was intended to cast a realistic, comprehensive and critical look at this phenomenon. Therefore, we opted for a socio-legal-critical research, conducted by the descriptive method, of a qualitative nature, with a careful bibliographical review. As a result, it is possible to conclude that there is solid evidence that the dominant ideology of each era is decisive for the epistemological development, methods and techniques oriented to fulfill the research objects and the chosen theoretical framework, strongly contradicting the myths of scientism and scientific neutrality.
