Abstract

This article aims to discuss succession planning in accordance with the Brazilian legal system, presenting the advantages and disadvantages of these mechanisms, as well as their precepts according to fundamental rights. Thus, it brings the concept of hereditary succession and the species of successors, focusing, especially, on legitimate succession, as a way of meeting the equality between the descendants, and the creation of the family holding. Finally, it is inferred that the world pandemic caused a scenario of uncertainties and it was in this context that the instrument under analysis began to grow exponentially in Brazilian society, since it proves to be of great use to avoid family conflicts, from the opening of succession, considerably reducing the succession process and the litigation procedures.
