Abstract

The digital revolution is not an option. It is, in short, a path of no return that, in addition to modifying interpersonal relationships, also changed the way of governing, because countries began to identify obstacles to governability in a world that, in addition to being globalized, also lives the results of the Fourth Industrial Revolution that changed the very meaning of governance and limits, including constitutional ones. In this scenario, the present research aims to verify the role of Artificial Intelligence in a globalized world, using the Fourth Industrial Revolution and the phenomenon of Transnationality as an optics, which is the general objective. As specific objectives, the following were listed: conceptualizing the Fourth Industrial Revolution, contextualizing the reader about the moment in which it arises, as well as conceptualizing Artificial Intelligence and pointing out some manifestations in the informational age; conceptualize globalization and discuss the phenomenon of Transnationality, demonstrating the relationship between the concepts and, finally, verifying the role of Artificial Intelligence in the face of the phenomenon of Transnationality. As for the methodology, the inductive method was used, with fundamentally bibliographic resources, through the reading of doctrines and essays referring to sociology, digital law, and materials involving the themes discussed. Finally, even without exhausting the topic, it was possible to observe that Artificial Intelligence, despite being a positive exponent of the fourth industrial revolution, presents sufficient reasons for States to identify alternatives to limit their performance, in order to protect data and information. and consolidate fundamental rights.

Vice Dean of Undergraduate Studies at UNIVALI. He holds a degree in Law from the Federal University of Santa Maria (1992), a degree in Science from the Federal University of Santa Maria (1984) and a Master's in Regional Development from the Regional University Foundation of Blumenau (2002) and a PhD in Legal Science from the University of Vale do Itajaí (2016). Post-Doctorate at the University of Passo Fundo (UPF). He was Coordinator of FORTEC/SUL. Professor of the Master's/Doctoral program in Legal Science at UNIVALI.
