This article deals with infiltration as a technique of state intelligence and its application in the Brazilian intelligence service after redemocratization. The following problem was investigated: is there a possibility of infiltrating agents that are not covered by Law 12,850/13, in order to subsidize criminal proceedings? The objectives are: to discuss the technique; review the legislation and assess the control of the activity. This work has professional importance due to the possibility of clarifying intelligence laws and their adequate control. Scientific relevance involves the discussion of a topic that still suffers negative influences from the anti-democratic period. It brings society together for the possibility of greater social control. It is a theoretical, bibliographical research lasting three months.
