A TRANSPARENTALIDADE POR MEIO DA ADOÇÃO: REFLEXÕES SOBRE INVISIBILIDADES NO DIREITO BRASILEIRO
Abstract
The main objective of the present work is to analyze the obstacles to legal adoption carried out by transgender people and transvestites, in a single parent or joint form, of children and adolescents in Brazil. The methodological approach was qualitative, through bibliographic and documental procedures, to understand the failed attempt to recognize transparentality and the challenge of the perceptions of transgenderism in the social sphere. The research carried out here indicates that the topic discussed is made invisible, as shown by the few references that deal with the topic with specificity and legal omissions. Therefore, this work is justified as an attempt to denounce the neglect of the reproductive rights of trans people, indicating that these should be thought of in order to consider individualities from a pluralist perspective, from constitutional principles and values, consistent with the human dignity and the centrality of affection in family law, and no longer from the paradigm of an abstract “universal” subject, which preserves and perpetuates the multiple hierarchies of coloniality.
