ABERRATIO RELATIONE: OPERAÇÃO “LAVA JATO” EM CONLUIOS

Abstract

On June 09, 2019 the news agency The Intercept published a series of reports exposing pieces of what would become one of the biggest national scandals involving the Federal Judiciary and the Federal Prosecution. Members of the Task Force the Operation "Lava-Jato", which is how are known the Federal Prosecutors responsible for leading several corruption investigation and corruption charges in Brazil, and the 13th Criminal Court of Curitiba had their dialogues exposed by journalists, revealing possible collusion between them. This paper brings an analysis of the Federal Prosecutors and Federal Judge conducts with the dictates of the Criminal Proceeding Code, focusing on the possible occurring of suspicion by the Federal Judge. Therefore, at first was exposed the content of the dialogues and acts practiced by the involved, just as the absence of their denial about the dialogue's veracity, intending to provide full context to this paper. Moving forward this paper analyzed the conducts with the dictates of the national legislation and jurisprudence, as well as foreign legislation and foreign jurisprudence. Thus, according with the data presented and analyzed, it is concluded that several Constitutional and Infracosntitutional were totally ignored during the Operation "Lava-Jato", specially regarding the counseling and even the possibility of coordination of the accusation activities.
