CONSTITUCIONALISMO, COLONIALISMO E DIREITOS HUMANOS: UMA LUTA POR INCLUSÃO E JUSTIÇA SOCIAL
Abstract
The objective of the research is to demonstrate the importance of inclusion in the construction of Brazilian social struggles. Thus, a critical reading of constitutionalism and human rights was used, with the aim of approaching legal phenomena and specificities peculiar to Brazilian culture. Given this, the central question of this study arises: What is the contribution of inclusion to the realization of inclusive human rights in Brazil? The research methodology is qualitative and bibliographical as it seeks sources in the legal doctrine related to the theme and quantitative, and the method used is essentially deductive. Researching human rights must go beyond the traditional conceptions established by laws and treaties, it is necessary and reasonable to examine each culture according to its specificities. Thus, the study is justified because it addresses constitutionalism and human rights in a critical perspective.
