A CONSTELAÇÃO SISTÊMICA COMO INSTRUMENTO DE REDUÇÃO DA JUDICIALIZAÇÃO DAS DEMANDAS: SOLUÇÃO DE CONFLITOS E JUSTIÇA HUMANIZADA
Abstract
This paper will present the systemic constellation called psychotherapeutic method often applied in the country's courts, and its effects on legalization of demands, issue of paramount importance to the development of a comprehensive national policy that promotes appropriate and lasting solutions, whose role is increasingly important being an alternative method in the promotion of humanized justice. Therefore, the present work has as scope to analyze the results obtained until then, by this alternative method in the resolution of lides and promotion of social peace, as well as to explain about the possibilities of regulation and expansion of use against the Resolution 125/2010 of the CNJ that opens up the possibility of adopting new consensual methods of conflict. Thus, this work was used literature as well as semi-structured interviews with professionals conciliators and psychologist, in order to to obtain qualified opinion of those who work (in) directly with the method, thus completing the literature search. The results of this work reveal that the constellation is of fundamental importance for the observance of the principle of due process as show the opinions collected in the interviews and analysis of the results obtained in the 2nd Itabuna / BA Family Court.Downloads
