Attachment a "on line" - effective means of implementation

Abstract

The Institute was established pledge online to streamline enforcement proceedings pending in court after the implementation of an agreement between the Superior Labor Court and BacenJud - Capital Bank of Brazil. Although there are disagreements in doctrine and jurisprudence itself on the constitutionality of the measure, given the debtor to enforce submission to its guidelines, without actually favors the principle of lowest burden, not the original idea in conflict, inserted in the practice of this attachment, that speed is the vogue of the procedure. Even before these debates, the majority doctrine is heading for the consolidation of rule by allying themselves with the thought of computerization of the judicial process. And within the broad perspective of successful outcome of the demands on executive who handles the online application of attachment, the judiciary compiles the effectiveness of the procedure, and spreads its consolidation as the most effective way to guarantee success in the election officer.
