PREGNANCY BEHIND THE GRILLS: WOMEN IN JAIL AND THE STATUTE OF FIRST CHILDHOOD

Female incarceration reveals some gender inequalities due to the lack of better care conditions for women prisoners. It can be understood that wo men are often deprived of access to the public sphere, external work, participation in the choices of their representatives, being restricted to the domestic space of private life that supported the principles of hierarchy between genders. Female incarceration grows at an accelerated rate, leading to a certain invisibility on the issues posed by the imprisonment of women. In this sense, this thesis aims to analyze the situation of women who are incarcerated in Brazil. The method adopted in the research was hypothetical deductive, as the problem was verified; formulating the hypotheses for its solution; and conducting the hypothesis corroboration process. According to Mezzaroba; Monteiro (2017) the starting points of the research take the form of working hypotheses that will be verified in the course of the inquiry activity. It is concluded that, in a way, children living in prison, daughters of imprisoned mothers, even if not convicted, are in confinement. They are arrested without any conviction and without committing any conduct that could be considered a crime. The children of incarcerated women suffer numerous restrictions, such as not being able to have contact with other family members. Women live in an environment that is unsuitable for pregnancy. Thus, very little of the Brazilian legislation is put into practice.
