Abstract

As a primary objective of this paper, a critical analysis of the legislation pertinent to Family Planning is made, giving priority to what concerns the feasibility of carrying out female sterilizing procedures, among which the Tubal Laqueadura stands out. In this sense, it is guided by a doctrinal bibliographical research about Constitutional Law, delving into Fundamental Rights, as well as Family Law, through the Family Planning Law, in order to present a critical analysis of the mandatory requirements. for female sterilization in Brazil. Thus, we seek to defend the constitutionality of the mandatory requirements prescribed by the Family Planning Law in opposition to the unconstitutionality of the moral requirements imposed by health professionals.
